1. Introduction

Welcome to Storyteller.Energy (“Platform”), a quantum learning platform managed and created by The Hive Social Garden, Inc. (“The Hive”). These Terms and Conditions (“Terms”) govern your access to and use of the Platform, provided by the Space and Military Learning Experience (S/MILE) for the purpose of learning quantum intelligence, ethical social engineering, and sustainable globalization. By accessing or using the Platform, you (“User”) agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Platform.

2. Access and Use

2.1 Eligibility: The Platform is intended for use by individuals authorized by S/MILE. You must be at least 18 years old and have the legal capacity to enter into these Terms or you must have a signed agreement with your parent or guardian’s signature for an U18 account.

2.2 Account: You may be required to create an account to access certain features of the Platform. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2.3 Permitted Use: You may use the Platform solely for the purpose of learning quantum intelligence, ethical social engineering, and sustainable globalization as part of S/MILE’s educational program.

2.4 Prohibited Use: You may not use the Platform for any illegal, unauthorized, or unethical purpose. Prohibited activities include, but are not limited to:

  • Violating any applicable laws or regulations.
  • Infringing on the intellectual property rights of others.
  • Impersonating any person or entity.
  • Interfering with or disrupting the Platform or servers.
  • Attempting to gain unauthorized access to the Platform or User accounts.
  • Engaging in any activity that could harm, disable, overburden, or impair the Platform.
  • Using the Platform to transmit any viruses, worms, defects, Trojan horses, or other items of a destructive nature.
  • Using the Platform to collect or harvest any personally identifiable information from other Users.

3. Intellectual Property

3.1 Ownership: The Platform and its content, including but not limited to text, graphics, images, videos, software, and trademarks, are owned by or licensed to The Hive and are protected by intellectual property laws.

3.2 Limited License: The Hive grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for the permitted purposes.

3.3 No Modification: You may not modify, reproduce, distribute, create derivative works of, publicly display, or perform the Platform or its content without the prior written consent of The Hive.

4. Disclaimer

4.1 No Warranty: The Platform is provided “as is” without any warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

4.2 Accuracy: The Hive makes no representations or warranties about the accuracy, completeness, reliability, or timeliness of the Platform or its content.

4.3 Availability: The Hive does not guarantee that the Platform will be available at all times or that access will be uninterrupted or error-free.

5. Limitation of Liability

5.1 Indirect Damages: In no event shall The Hive be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform, even if The Hive has been advised of the possibility of such damages.

5.2 Direct Damages: The Hive’s total liability to you for any direct damages arising out of or related to these Terms shall be limited to the amount paid by you, if any, for access to the Platform.

6. Indemnification

You agree to indemnify and hold harmless The Hive, its affiliates, officers, directors, employees, and agents from any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or related to your use of the Platform or your breach of these Terms.

7. Termination

7.1 By The Hive: The Hive may terminate your access to the Platform at any time, for any reason, with or without notice.

7.2 By You: You may terminate your access to the Platform by ceasing your use of the Platform and deleting your account, if applicable.

7.3 Effect of Termination: Upon termination, your right to access and use the Platform shall cease.

8. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Virginia, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Fairfax County, Virginia.

9. Entire Agreement

These Terms constitute the entire agreement between you and The Hive relating to the subject matter herein and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

10. Amendments

The Hive reserves the right to amend these Terms at any time by posting the updated Terms on the Platform. Your continued use of the Platform following the posting of any updated Terms constitutes your acceptance of such updated Terms.
